General Terms and Conditions

1. You must be at least 18 years old to use this site. This includes posting and bidding on any auction items.

2. As a member of Aggieland Auctions, you are required to maintain complete and valid contact information at all times.

3. Descriptions are provided by the seller and are believed to be true and correct to the best of our knowledge.

4. Aggieland Auctions will assume no responsibility and make no warranties regarding any items. It is the bidder’s responsibility and obligation to verify information and descriptions prior to bidding.

5. All bids are a legal and binding contract, once placed they CANNOT be retracted. If you don't pay for the item after winning/purchase, seller has right to list buyer/winner as a "non-paying" bidder by leaving a negative reputation. If you receive 3 non-paying bidder strikes, your account will be suspended.

6. Arrangements for pickup or shipping of purchased items will be the sole responsibility of the winning bidder/buyer. Aggieland Auctions does not provide transportation or loading services of any kind. Winning bidder/buyer assumes all risks and expenses for removal.

7. Aggieland Auctions will NOT be held responsible for any damage to items incurred during packing, loading, lifting, towing or hauling in regards to removal or handling of auction items.

8. Winning bidder/buyer is responsible for all shipping charges for items that are shippable via UPS, USPS, Fed Ex, DHL or any other carrier, unless prearranged by seller.

9. All items are sold as is and where is and are final, unless special arrangements have been made with the seller. Winning bidder/buyer is responsible for all liabilities attached to the auction item. Should the item turn up missing at pickup time, please contact the local police authorities and report them as stolen, no refunds will be made by Aggieland Auctions or the seller, unless otherwise stated.

10. Advertising of your own store or website within an auction is not allowed, unless you have purchased one of our stores. Please do not use Aggieland Auctions to redirect visitors to your own store or website. You may only link to images/pictures on another web site from within an auction.

Aggieland Auctions is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining. If you spot a listing that you feel is violating the general terms and conditions of this website as stated below please let us know by contacting us at info@aggielandauctions.com.

Rights To Suspend or Terminate.
You agree that Aggieland Auctions, in its own discretion, may terminate any auction or use of the service immediately and without notice if

(a) We believe that you are not abiding by the general rules of this website
(b) You have repeatedly broken any of the terms listed here.
(c) You have listed a suspicious or illegal item
(d) We believe you to be a non paying bidder.

In most cases when we suspect foul play we will suspend your account/listing while we investigate further. If our suspicions are conclusive then your account with us will be terminated.

Your Conduct.
You are solely responsible for the contents of your actions on and through this website. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you are entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.

You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation.

Membership.
Membership to the Aggieland Auctions website is only available to those than can form a legally binding contract. Aggieland Auctions does not permit minors (under 18) to register. If any member signs up with and has falsified their age their account will be terminated immediately.

General Terms.
This site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items.

We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretenses.

Aggieland Auctions shall not be responsible for any items sold by auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller.

Aggieland Auctions shall not be responsible for the cost of procurement of substitute goods or any losses resulting from any goods purchased or obtained.

Aggieland Auctions assumes no liability for the content of the listings.
However if you fall victim of a fraudulent transaction we will assist you as much as we can.

Aggieland Auctions has the right to advertise using any items that are currently listed, have sold or closed without sales purely at our discretion.

Laws.
These Terms of Service shall be governed by and constructed in accordance with the laws of the State of Texas, County of Burleson, only by the Courts of Burleson County.

YOUR USE OF THIS SITE SIGNIFIES AND CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT, AS IT MAY BE AMENDED FROM TIME TO TIME.
